勞(lao)務(wu)(wu)派(pai)遣(qian)是(shi)指由勞(lao)務(wu)(wu)派(pai)遣(qian)機構(gou)與派(pai)遣(qian)勞(lao)工訂立勞(lao)動合同,把勞(lao)動者(zhe)派(pai)向(xiang)其(qi)他用(yong)工單位,再(zai)由其(qi)用(yong)工單位向(xiang)派(pai)遣(qian)機構(gou)支付一(yi)(yi)筆(bi)服務(wu)(wu)費用(yong)的一(yi)(yi)種用(yong)工形式。英文是(shi)Labor Dispatching,又稱人力(li)(li)派(pai)遣(qian)、人才租賃、勞(lao)動派(pai)遣(qian)、勞(lao)動力(li)(li)租賃、雇(gu)員(yuan)租賃。
勞(lao)(lao)動力給付的事實(shi)發生(sheng)于派(pai)(pai)(pai)遣勞(lao)(lao)工與要(yao)派(pai)(pai)(pai)企業(ye)(實(shi)際用工單位)之(zhi)間,要(yao)派(pai)(pai)(pai)企業(ye)向(xiang)勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣機(ji)構(gou)支付服務(wu)費,勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣機(ji)構(gou)向(xiang)勞(lao)(lao)動者支付勞(lao)(lao)動報(bao)酬。勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣起(qi)源于20世紀(ji)的資(zi)本主義國(guo)家(jia)美國(guo),后(hou)傳至法國(guo)、德國(guo)、日本等國(guo)。90年代在我(wo)國(guo)國(guo)有企業(ye)勞(lao)(lao)動制(zhi)度改(gai)革中(zhong),出現了為安置下崗職工而產(chan)生(sheng)的勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣,可跨地區、跨行業(ye)進行,現年薪通(tong)常為5萬(wan)—10萬(wan)。
一般經省市勞動人(ren)(ren)事(shi)部門(men)廳批(pi)準(zhun)可成立專業(ye)(ye)的人(ren)(ren)力(li)資(zi)源(yuan)服務公司,主營業(ye)(ye)務有人(ren)(ren)力(li)資(zi)源(yuan)外包,人(ren)(ren)力(li)資(zi)源(yuan)派遣(qian)以及通(tong)過(guo)招(zhao)聘網為(wei)企(qi)業(ye)(ye)提供(gong)人(ren)(ren)才的供(gong)應信(xin)息,為(wei)個人(ren)(ren)提供(gong)求職登記,推薦工(gong)作(zuo);同時也為(wei)企(qi)業(ye)(ye)提供(gong)代理招(zhao)聘會的舉(ju)辦,法律法規的咨詢等工(gong)作(zuo)。
勞(lao)務(wu)(wu)派(pai)遣(qian)(qian)(qian)一(yi)般在(zai)(zai)臨時(shi)性(xing)、輔助(zhu)性(xing)或者替代(dai)性(xing)的(de)(de)(de)工(gong)(gong)(gong)(gong)作(zuo)崗(gang)位(wei)(wei)(wei)上(shang)實(shi)施(shi)(shi)(shi)(shi)。《勞(lao)動(dong)(dong)(dong)合同法(fa)(fa)》第六十六條明(ming)確規定:“勞(lao)動(dong)(dong)(dong)合同用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)是我國的(de)(de)(de)企業(ye)基本用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)形(xing)(xing)式(shi)。勞(lao)務(wu)(wu)派(pai)遣(qian)(qian)(qian)用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)是補充(chong)形(xing)(xing)式(shi),只能在(zai)(zai)臨時(shi)性(xing)、輔助(zhu)性(xing)或者替代(dai)性(xing)的(de)(de)(de)工(gong)(gong)(gong)(gong)作(zuo)崗(gang)位(wei)(wei)(wei)上(shang)實(shi)施(shi)(shi)(shi)(shi)。”但不(bu)少用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)在(zai)(zai)各(ge)種(zhong)類型、各(ge)種(zhong)時(shi)間長度的(de)(de)(de)工(gong)(gong)(gong)(gong)作(zuo)崗(gang)位(wei)(wei)(wei)上(shang)都實(shi)施(shi)(shi)(shi)(shi)了(le)勞(lao)務(wu)(wu)派(pai)遣(qian)(qian)(qian),甚至在(zai)(zai)其(qi)主營業(ye)務(wu)(wu)崗(gang)位(wei)(wei)(wei)大(da)量使用(yong)(yong)(yong)(yong)勞(lao)務(wu)(wu)派(pai)遣(qian)(qian)(qian)工(gong)(gong)(gong)(gong)。 [2] 隨著1995年《勞(lao)動(dong)(dong)(dong)法(fa)(fa)》的(de)(de)(de)實(shi)施(shi)(shi)(shi)(shi),我國已(yi)經消除(chu)“正式(shi)工(gong)(gong)(gong)(gong)”、“臨時(shi)工(gong)(gong)(gong)(gong)”的(de)(de)(de)二元用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)體制(zhi)。勞(lao)務(wu)(wu)派(pai)遣(qian)(qian)(qian)的(de)(de)(de)濫用(yong)(yong)(yong)(yong),導致了(le)新的(de)(de)(de)二元用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)體制(zhi)。《勞(lao)動(dong)(dong)(dong)合同法(fa)(fa)》實(shi)施(shi)(shi)(shi)(shi)后,出(chu)現了(le)新的(de)(de)(de)“正式(shi)員工(gong)(gong)(gong)(gong)”、“被派(pai)遣(qian)(qian)(qian)勞(lao)動(dong)(dong)(dong)者”二元用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)體制(zhi)。在(zai)(zai)用(yong)(yong)(yong)(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)中,被派(pai)遣(qian)(qian)(qian)勞(lao)動(dong)(dong)(dong)者承擔一(yi)線工(gong)(gong)(gong)(gong)作(zuo),為(wei)(wei)企業(ye)發(fa)展做出(chu)直接貢獻(xian),卻成為(wei)(wei)“二等(deng)”員工(gong)(gong)(gong)(gong)群體。現在(zai)(zai)有一(yi)種(zhong)“逆向派(pai)遣(qian)(qian)(qian)”的(de)(de)(de)怪(guai)象,一(yi)些(xie)用(yong)(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)在(zai)(zai)勞(lao)動(dong)(dong)(dong)合同法(fa)(fa)實(shi)施(shi)(shi)(shi)(shi)后,要求正式(shi)合同工(gong)(gong)(gong)(gong)與勞(lao)務(wu)(wu)公司簽訂派(pai)遣(qian)(qian)(qian)合同轉為(wei)(wei)勞(lao)務(wu)(wu)派(pai)遣(qian)(qian)(qian)工(gong)(gong)(gong)(gong),再派(pai)回到原(yuan)來的(de)(de)(de)工(gong)(gong)(gong)(gong)作(zuo)崗(gang)位(wei)(wei)(wei)上(shang)去。勞(lao)務(wu)(wu)派(pai)遣(qian)(qian)(qian)已(yi)經成為(wei)(wei)部分用(yong)(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)規避《勞(lao)動(dong)(dong)(dong)合同法(fa)(fa)》規定的(de)(de)(de)用(yong)(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)責任(ren)的(de)(de)(de)一(yi)種(zhong)途徑。
