勞(lao)務派(pai)(pai)(pai)遣(qian)(qian)(qian)是(shi)指由(you)勞(lao)務派(pai)(pai)(pai)遣(qian)(qian)(qian)機構(gou)(gou)與派(pai)(pai)(pai)遣(qian)(qian)(qian)勞(lao)工(gong)訂立勞(lao)動(dong)(dong)合同(tong),把(ba)勞(lao)動(dong)(dong)者派(pai)(pai)(pai)向其他(ta)用工(gong)單位,再由(you)其用工(gong)單位向派(pai)(pai)(pai)遣(qian)(qian)(qian)機構(gou)(gou)支付一筆(bi)服務費用的一種用工(gong)形式(shi)。英文(wen)是(shi)Labor Dispatching,又稱人力派(pai)(pai)(pai)遣(qian)(qian)(qian)、人才租(zu)賃(lin)、勞(lao)動(dong)(dong)派(pai)(pai)(pai)遣(qian)(qian)(qian)、勞(lao)動(dong)(dong)力租(zu)賃(lin)、雇員租(zu)賃(lin)。
勞(lao)動(dong)力給付的(de)事實(shi)發生于派(pai)遣勞(lao)工與要派(pai)企業(實(shi)際用工單位)之間,要派(pai)企業向(xiang)勞(lao)務派(pai)遣機構(gou)支付服(fu)務費,勞(lao)務派(pai)遣機構(gou)向(xiang)勞(lao)動(dong)者支付勞(lao)動(dong)報酬。勞(lao)務派(pai)遣起源于20世紀(ji)的(de)資本主義國家美國,后(hou)傳至法國、德國、日(ri)本等國。90年代在我國國有企業勞(lao)動(dong)制度(du)改革中,出現了為安置(zhi)下崗(gang)職(zhi)工而(er)產生的(de)勞(lao)務派(pai)遣,可跨地區、跨行(xing)業進行(xing),現年薪通常為5萬—10萬。
一般經(jing)省市(shi)勞(lao)動人(ren)事部門廳(ting)批準可(ke)成立專業的(de)(de)人(ren)力資(zi)源服務公(gong)司(si),主營業務有人(ren)力資(zi)源外包,人(ren)力資(zi)源派遣以及通過招(zhao)聘網為企(qi)業提(ti)供(gong)(gong)人(ren)才的(de)(de)供(gong)(gong)應信息,為個人(ren)提(ti)供(gong)(gong)求職登記,推薦(jian)工(gong)作;同(tong)時也為企(qi)業提(ti)供(gong)(gong)代(dai)理招(zhao)聘會的(de)(de)舉(ju)辦(ban),法律法規(gui)的(de)(de)咨詢等工(gong)作。
勞(lao)(lao)(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)(qian)一(yi)(yi)般在(zai)臨(lin)時(shi)性(xing)(xing)、輔助性(xing)(xing)或(huo)(huo)者替(ti)代性(xing)(xing)的(de)(de)(de)(de)工(gong)(gong)作(zuo)崗(gang)位(wei)(wei)上實(shi)施(shi)。《勞(lao)(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)法(fa)》第六十六條(tiao)明確規(gui)定(ding):“勞(lao)(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)用(yong)工(gong)(gong)是我國的(de)(de)(de)(de)企業(ye)基本用(yong)工(gong)(gong)形(xing)式。勞(lao)(lao)(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)(qian)用(yong)工(gong)(gong)是補充形(xing)式,只能在(zai)臨(lin)時(shi)性(xing)(xing)、輔助性(xing)(xing)或(huo)(huo)者替(ti)代性(xing)(xing)的(de)(de)(de)(de)工(gong)(gong)作(zuo)崗(gang)位(wei)(wei)上實(shi)施(shi)。”但(dan)不少用(yong)工(gong)(gong)單(dan)位(wei)(wei)在(zai)各種(zhong)(zhong)類型、各種(zhong)(zhong)時(shi)間長度的(de)(de)(de)(de)工(gong)(gong)作(zuo)崗(gang)位(wei)(wei)上都(dou)實(shi)施(shi)了勞(lao)(lao)(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)(qian),甚至在(zai)其主營業(ye)務(wu)崗(gang)位(wei)(wei)大量使用(yong)勞(lao)(lao)(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)(qian)工(gong)(gong)。 [2] 隨著1995年(nian)《勞(lao)(lao)(lao)(lao)動(dong)法(fa)》的(de)(de)(de)(de)實(shi)施(shi),我國已經(jing)消(xiao)除“正式工(gong)(gong)”、“臨(lin)時(shi)工(gong)(gong)”的(de)(de)(de)(de)二元(yuan)用(yong)工(gong)(gong)體制(zhi)(zhi)。勞(lao)(lao)(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)(qian)的(de)(de)(de)(de)濫(lan)用(yong),導致了新(xin)(xin)的(de)(de)(de)(de)二元(yuan)用(yong)工(gong)(gong)體制(zhi)(zhi)。《勞(lao)(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)法(fa)》實(shi)施(shi)后,出現了新(xin)(xin)的(de)(de)(de)(de)“正式員工(gong)(gong)”、“被派(pai)(pai)(pai)遣(qian)(qian)勞(lao)(lao)(lao)(lao)動(dong)者”二元(yuan)用(yong)工(gong)(gong)體制(zhi)(zhi)。在(zai)用(yong)工(gong)(gong)單(dan)位(wei)(wei)中,被派(pai)(pai)(pai)遣(qian)(qian)勞(lao)(lao)(lao)(lao)動(dong)者承擔一(yi)(yi)線工(gong)(gong)作(zuo),為(wei)企業(ye)發展做出直接貢獻,卻成(cheng)為(wei)“二等”員工(gong)(gong)群體。現在(zai)有一(yi)(yi)種(zhong)(zhong)“逆向(xiang)派(pai)(pai)(pai)遣(qian)(qian)”的(de)(de)(de)(de)怪象(xiang),一(yi)(yi)些用(yong)人單(dan)位(wei)(wei)在(zai)勞(lao)(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)法(fa)實(shi)施(shi)后,要(yao)求正式合(he)(he)同(tong)(tong)工(gong)(gong)與勞(lao)(lao)(lao)(lao)務(wu)公司簽(qian)訂派(pai)(pai)(pai)遣(qian)(qian)合(he)(he)同(tong)(tong)轉為(wei)勞(lao)(lao)(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)(qian)工(gong)(gong),再派(pai)(pai)(pai)回到原來的(de)(de)(de)(de)工(gong)(gong)作(zuo)崗(gang)位(wei)(wei)上去。勞(lao)(lao)(lao)(lao)務(wu)派(pai)(pai)(pai)遣(qian)(qian)已經(jing)成(cheng)為(wei)部(bu)分用(yong)人單(dan)位(wei)(wei)規(gui)避(bi)《勞(lao)(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)法(fa)》規(gui)定(ding)的(de)(de)(de)(de)用(yong)人單(dan)位(wei)(wei)責任(ren)的(de)(de)(de)(de)一(yi)(yi)種(zhong)(zhong)途(tu)徑。
